You, by acceptance and or purchase from Light Marine Services, LLC (“Lighthouse Marine Services, LLC”, “Us”, “Our” , “Seller”) do hereby acknowledge your acceptance of the terms and conditions herein. The terms “You”, “I”, “My” ,“Customer” or “Client” means you, the purchaser, your agents, beneficiaries, or heirs. I hereby authorize the repair work to be done along with necessary materials. Lighthouse Marine Services, LLC and employees may operate the unit for the purposes of testing, inspection, transportation or delivery at my risk. An expressed Mechanic’s lien is acknowledged on the unit to secure the amount of repairs thereto. Lighthouse Marine Services, LLC will not be held responsible for loss or damage to unit. I understand the unit will not be released from Lighthouse Marine Services, LLC until all outstanding invoices are paid in full. Please Note: final price is subject to change and may in some cases reflect cost of labor only. Any unforeseen issues that may require additional labor, parts or resources will require additional payment. If not already listed on estimate and or invoice other necessary items to complete job successfully such as fluids, gaskets, shop supplies etc. will be charged in addition to the initial estimated price. ALL Engine R&R jobs require 50% deposit to secure shop time and initiate job. Thank you for your understanding and we look forward to earning your business!
Payments
ALL payments are C.O.D. and payable upon receipt. Payments submitted electronically or by card will carry a 3% surcharge processing fee.
Refunds
NO refunds on services and or labor rendered unless otherwise approved by Lighthouse Marine Services, LLC in writing. Refunds on parts and products are accepted within 7 days of purchase with substantiation and original receipt. Defective parts can be warrantied through the original manufacturer if applicable. Lighthouse Marine Services, LLC is not responsible for parts found to be defective do to manufacturers defect in parts or workmanship. Lighthouse Marine Services, LLC in it’s sole discretion may determine if the claimed fault or repair requested is covered by warranty.
Force Majeure
Lighthouse Marine Services, LLC shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that Lighthouse Marine Services, LLC will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The client acknowledges and agrees that Lighthouse Marine Services, LLC cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
Severability
If any provision, paragraph or subparagraph of the terms and conditions herein is adjudicated by any Court to be void and unenforceable in whole or in part, such adjudication shall not be deemed to affect the validity of the remainder of the terms and conditions, including any other provision, paragraph or subparagraph. Each provision, paragraph or subparagraph herein is declared to be separable from each other provision, paragraph or subparagraph and constitutes a separate, distinct covenant. Titles: Titles and headings to articles, sections, or paragraphs in this Agreement are inserted for convenience of reference only and are not intended to effect the interpretation or construction of the Terms and Conditions.
